Redworks–KPN 084/087 Number Accessibility Dispute

In a formal dispute initiated by Redworks, ACM required KPN to make Redworks’ 084/087 numbers accessible. The proceedings also addressed the boundary between regulated call termination and remuneration for a separate follow-on service.

Issue

The dispute combined number accessibility, interconnection and service characterization. The public record distinguishes the regulated delivery of a call from the service supplied after that delivery.

Why the distinction matters

  • Technical call flow does not automatically determine the legal or commercial characterization of every service in the chain.
  • Accurate analysis requires mapping the network handoff, the service boundaries and the party performing each function.

Appellate history

The later CBb publication reports that ACM correctly concluded KPN was not required to negotiate with Redworks over the follow-on service. The accessibility determination and the remuneration issue therefore need to be described separately.
