Selecting an Expert for a Cross-Border EU–U.S. Telecom Dispute

Cross-border telecom disputes are not solved by placing two regulatory summaries side by side. The expert must understand how ownership, authorization, numbering, interconnection, vendors, traffic and operational control connect across jurisdictions.

Questions that cross borders

  • Which entity held the relevant authorization or numbering resource?
  • Where was the network function actually performed?
  • Which party controlled the platform, customer, traffic or data?
  • How did EU and U.S. duties attach to the corporate and technical structure?
  • Which records exist in each jurisdiction, and can they be aligned to one chronology?

Useful experience for the assignment

  • European licensed-operator and carrier-dispute experience
  • FCC registration, Form 499 and international Section 214 familiarity
  • Team Telecom-related foreign-ownership review
  • North American numbering and California registration
  • International interconnection, vendors, data flows and regulated operations

Avoid false equivalence

Terms such as carrier, operator, authorization, number ownership and interception can have different legal and operational meanings across jurisdictions. The expert should define the function and evidence before assuming that a familiar label carries the same consequence elsewhere.
